Terms of service

You must be legally able to enter into these terms and provide accurate account information. You are responsible for activity under your account, protecting access to it, and ensuring that authorized team members follow these terms.

Tracwell provides hosted website and product analytics, event collection, reporting, integrations, APIs, SDKs, and related tools. Features may change as the service develops.

You retain ownership of the data you send to Tracwell. You grant Tracwell permission to host, process, transmit, and display that data only as needed to provide, secure, support, and improve the service.

You are responsible for:

• Having a lawful basis to collect and process analytics data.
• Providing required privacy notices and consent choices.
• Configuring collection mode, consent, identity, and retention appropriately.
• Avoiding passwords, payment-card details, health information, and other unnecessary sensitive information in event properties.
• Responding to requests from visitors whose data you control.

Tracwell's handling of account and analytics information is described in the privacy policy.

You must not use Tracwell to:

• Break the law or infringe another person's rights.
• Track people without the notice, consent, or authority required by law.
• Collect prohibited or unnecessary sensitive information.
• Probe, disrupt, overload, or bypass service security or usage controls.
• Resell access, impersonate another person, or misuse credentials or project keys.
• Upload malicious code or use the service to harm another system or person.

Paid plans include the prices, billing interval, event allowance, website allowance, retention, and trial terms shown on the pricing page or at checkout. Unless checkout says otherwise, subscriptions renew automatically until cancelled. Taxes and payment-provider fees may apply where stated.

You can cancel through the billing portal. Cancellation normally takes effect at the end of the current paid period. Except where required by law or stated at checkout, paid fees are non-refundable. Failed, expired, cancelled, or unpaid subscriptions may lose collection access while retaining limited access to explore the dashboard.

Plan allowances are shared across the websites in your account. Events above the effective allowance may be rejected. Tracwell may apply reasonable request, query, export, and abuse limits to protect the service and other customers.

Prices or plan limits may change for future billing periods. Material changes affecting an active subscription will be communicated before they take effect where required. Tracwell may add, change, or remove features, but will not retroactively change a completed paid period's stated price.

Tracwell and its licensors own the service, software, branding, documentation, and related intellectual property. These terms give you a limited, non-exclusive, non-transferable right to use the service while your account is permitted to access it.

If you provide feedback, Tracwell may use it without restriction or compensation, but will not identify you publicly without permission.

Tracwell can connect to third-party services such as authentication and payment providers. Their terms and privacy practices govern your use of those services. Tracwell is not responsible for third-party services outside its control.

You may stop using Tracwell or delete your account at any time. Tracwell may suspend or terminate access when reasonably necessary to address non-payment, unlawful use, security risk, material breach of these terms, or harm to the service or others. When practical, notice and an opportunity to resolve the issue will be provided.

Account deletion is permanent. Provisions that by their nature should continue after termination—including payment obligations, ownership, disclaimers, and liability limits—remain effective.

Tracwell is provided on an “as is” and “as available” basis to the extent permitted by law. No guarantee is made that the service will be uninterrupted, error-free, or suitable for every legal or business requirement. Any service-level commitment must be agreed separately in writing.

To the maximum extent permitted by law, Tracwell will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, goodwill, or data. Tracwell's total liability arising from the service will not exceed the amount you paid for the service during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot legally be limited.

These terms may be updated as the service or legal requirements change. The date at the top identifies the latest version. Material changes will be communicated through the service or by email when appropriate. Continuing to use the service after the effective date means you accept the updated terms.
